1. Acceptance of Terms

By accessing or using NeuVybe's AI-powered music mixing platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

NeuVybe provides AI-curated, non-interactive streaming stations and related playback experiences. The Service currently includes:

  • Live-mixed station-style audio streams during beta availability windows
  • Intelligent track selection, sequencing, and beat matching
  • Curated station experiences and listening preferences
  • Beta features and experimental functionalities

3. Service Availability; United States Only

The Service is currently available only to users located in the United States. We may use geo-filtering and other verification methods to enforce this limitation. If you attempt to access the Service from outside the United States, we may restrict or terminate your access.

4. User Accounts

Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

Account Termination

6. Streaming Restrictions

You agree that you will not:

  • Record, copy, rip, reproduce, or archive audio or content from the Service
  • Redistribute, retransmit, rebroadcast, or publicly perform the Service
  • Use the Service as an input feed for a third-party platform, venue system, or restreaming tool without our written approval
  • Circumvent access controls, geo-restrictions, or technical protections

7. Intellectual Property

Our Property

All content, features, and functionality of the Service, including software, text, images, graphics, logos, and audio, are owned by NeuVybe or its licensors and are protected by intellectual property laws.

User Content

The Service may allow you to submit content such as messages, chat, reactions, or other community features if enabled. You grant us a non-exclusive, worldwide license to host, display, and distribute that content solely to operate and improve the Service.

We respect intellectual property rights and respond to valid DMCA takedown requests. If you believe your copyrighted work has been used inappropriately, please contact us.

8. Payment and Subscriptions

Pricing

Access to certain features requires a paid subscription. Pricing and payment terms will be clearly disclosed before you complete any purchase.

Billing

Subscriptions automatically renew unless canceled. You authorize us to charge your payment method for recurring fees.

Refunds

Refund policies will be clearly stated at the time of purchase. Generally, subscription fees are non-refundable except as required by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEUVYBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount paid by you to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless NeuVybe and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

14. Governing Law; Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to personal jurisdiction and venue in those courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and NeuVybe regarding the use of the Service and supersede all prior agreements and understandings.
